TERMS AND CONDITIONS
1. Scope of application
These General Terms and Conditions of Sale (GTC) apply to all orders placed through our website. This website's offering is intended exclusively for customers residing in Switzerland.
A customer is any natural or legal person who has business relationships with Tigusto.
Tigusto reserves the right to modify these Terms and Conditions at any time. The version valid at the time of the order is binding and cannot be modified unilaterally for that order. Customer conditions that conflict or deviate from these Terms and Conditions will not be recognized.

2. Information about the website
The Tigusto website contains information about products and services. Prices, product ranges, and technical specifications are subject to change. All information on www.tigusto.ch (product descriptions, images, illustrations, videos, measurements, weights, technical specifications, compatibility, etc.) is for guidance only and is not binding. They do not constitute guarantees of quality, unless explicitly stated otherwise.
Tigusto strives to provide accurate, complete, up-to-date, and clear information, but cannot explicitly or implicitly guarantee the accuracy of such data.
All offers on this site are non-binding and do not constitute binding contractual offers.
Tigusto does not guarantee that products will be available at the time of ordering. Information on availability and delivery times is indicative and may change at any time without notice.
3. Prices
The prices listed on www.tigusto.ch are final prices and include, unless otherwise indicated, the statutory VAT. Prices are expressed in Swiss francs (CHF).
Unless otherwise specified, any shipping costs are charged separately and are the responsibility of the customer. These costs are indicated separately during the ordering process.
We reserve the right to make technical changes, errors, and typos. Specifically, Tigusto may change prices at any time and without notice.
4. Conclusion of the contract
The products and prices shown on the site constitute a non-binding offer.
By submitting an order, including acceptance of these GTC, the customer makes a legally binding offer. Tigusto will then automatically send an order confirmation via email. This confirmation does not constitute acceptance of the contract.
The contract is concluded only when Tigusto sends a declaration of acceptance via email confirming the shipment of the ordered product or service.
Orders are shipped only after full payment has been received and provided the merchandise is available. If some or all of the merchandise is unavailable, Tigusto reserves the right to cancel or partially fulfill the order. In this case, the customer will be notified by email. If payment has already been made, the amount will be refunded.
5. Payment methods and retention of title
The available payment methods are indicated during the ordering process.
In case of late payments, Tigusto may charge late payment interest of 5% per year and a penalty of up to CHF 20.- per reminder.
The products remain the property of Tigusto until full payment has been made.
6. Delivery, inspection obligation, complaints and returns
Deliveries are made by post or courier to the address indicated by the customer in the order.
The order will be shipped via courier or our own vehicles within 72 business hours of receipt . The delivery deadlines indicated in the confirmation email are not binding. Tigusto can make partial deliveries, but will only charge a one-time shipping fee.
Invoices, where applicable, can be sent via email or post.
If the delivery is undeliverable or refused, Tigusto may withdraw from the contract after notifying the customer via email and granting them a reasonable extension of time. Any costs incurred will be charged to the customer.
The customer is obliged to check the received goods immediately and to report any defects in writing by e-mail or post (see imprint).
Returns are made at the customer's risk and expense. The goods must be returned in their original packaging, complete with accessories and delivery note, with a detailed description of the defects, to the address indicated in the Imprint.
If Tigusto's inspection shows that the products do not have defects or the defects are not covered by the warranty, Tigusto may charge the customer for the costs incurred.
7. Right of withdrawal
The customer can exercise the right of withdrawal within 10 calendar days of receiving the goods.
The right applies only to unopened products in their original packaging .
Simply send your cancellation in writing by email or post (address in the Imprint) within the deadline. No reason is required.
Withdrawal entails the termination of the contract. The customer must return the goods within 10 days, complete, packaged, and accompanied by the delivery document.
Returns are at the customer's expense and risk. Any payments already made will be refunded within 20 days, provided that Tigusto has received the goods or the customer provides proof of shipment.
Tigusto reserves the right to withhold a sum in the event of damage, excessive wear, or loss of value.
The right of withdrawal does not apply:
(i) to perishable products or products which by their very nature are not suitable for return;
(ii) to customized products upon customer request;
(iii) to products that must be delivered at specific times or dates.
8. Warranty
Tigusto is committed to providing high-quality products. In the event of defects reported promptly, Tigusto offers a 2-year warranty from the date of delivery. At its discretion, it may replace the product or refund the price.
The following are excluded from the warranty:

damage due to improper use

damage caused by third parties

external causes
- expired products
Tigusto cannot guarantee the accuracy, timeliness, or continued availability of the site, its content, features, or links.
9. Responsibility
Tigusto declines all responsibility for direct, indirect, consequential damages, lost profits, or other financial or personal damages arising from the use of the site or products.
The mandatory liability provided by law for wilful misconduct or gross negligence remains unaffected.
Links to external sites are provided for informational purposes only. Tigusto is not responsible for the content of such sites.
10. Data protection
Tigusto processes the data collected to fulfill the contract and for marketing purposes. The data may be shared with partners (e.g., logistics) to ensure the service.
Our privacy policy is available in the "Privacy Policy" section at the bottom of the site.
11. Safeguard clause
If any provision of these GTC is found to be invalid or unenforceable, the remaining provisions shall remain valid.
12. Final provisions
Tigusto reserves the right to modify these GTC at any time without notice.
In the event of disputes, Swiss law shall apply exclusively, excluding the conflict of laws rules and the Vienna Convention (CISG).
